Compliance Officer Daimler Truck Financial Services Asia Co., Ltd.

We are looking for an experienced Compliance professional to support our Head of Legal & Compliance Daimler Truck Financial Services Asia Co., Ltd. (DTFSA). Together, the team advises the company on all legal and compliance matters to protect the interests of DTFSA and managing together with the business team the legal risks and ensuring compliance with Daimler Truck policies and local laws.


Responsibilities:


COMPLIANCE
Coordinate the implementation and maintenance of an effective Compliance Management System for all relevant areas as described inter alia in the following at DTFSA in accordance with corporate requirements and local laws and regulations. Compliance risk assessments, performance monitoring and reporting,
• support of the local management in assuming and executing its responsibility to implement and maintain an effective Compliance program at the unit level in accordance with corporate Compliance Program requirements and local laws and regulations,
• Compliance and Integrity awareness at the unit level,
• obtaining support and collaboration from management and all employees,
• effective unit governance structures and procedures for compliance and integrity oversight and management, including defined accountability for compliance responsibilities,
• implementation and maintenance of clear standards of business and ethical conduct consistent with Daimler Truck corporate standards,
• implementation of risk-based control procedures based on Daimler Truck Compliance standard
• ongoing, effective communications and training on compliance requirements for both internal stakeholders as well as external business partners,


ANTI-CORRUPTION
Independently provide coordination, facilitation and oversight of key Compliance activities, including:
• Consultation on implementation of entity specific policies and procedures for the prevention of corruption.
• Providing a timely, effective and consistently applied Compliance consultation and documentation process,
• Business Partner Integrity Management; including due diligence process support
• Accounting for and monitoring government and other high risk transactions by supporting the Transaction Check,
• Identify local training demands and conduct training activities on local entity level regarding anti-corruption,
• Observing trends in local legislation


CHECKS AGAINST SANCTION LISTS (CSL)
Support and coordinate the entity-specific implementation of Checks against Sanctions Lists (CSL) in compliance with both applicable supranational and national laws in line with Daimler Truck Group Policy.
ANTI_MONEY LAUNDERING (AML)
Support local implementation of minimum standards and processes according to the group wide Daimler Truck Anti-Money Laundering and Counter Terrorist Financing (AML&CTF) policy, however subject to adaptations as required by locally applicable and stricter AML&CTF laws.


DATA COMPLIANCE
• Support and coordinate the entity-specific implementation of Data Protection requirements. This includes:
• Establish employee awareness of data protection topics
• Provide trainings
• Prepare local instructions
• Deal with complaints and requests of data subjects
• Local coordination of Incident Management
• Consult and support the departments on information obligations, deletion concepts, privacy by design/default and other DP topics; support by local Legal Counsel when required
• Consult and support the departments on Data Analytics use cases; support by local Legal Counsel when required
• Monitoring of data protection measures
• Monitoring of new data (protection) laws and regulations and identification of local implementation needs


INTEGRITY
• Promotion of the Code of Conduct and creation of awareness on the topic of integrity (e.g. support tone from the top)
• Support specific integrity initiatives/programs (e.g. error management culture, social media, data culture)


OTHER INTERNAL CONTROL TASKS
• As a Local Policy Advisor, watch revisions of applicable DT policies, consult and support policy owners to arrange enactment of those at the entity,
• Arrange and support the communication between the departments at entity and CoC such as Corporate Audit and Risk Review.
• Communicate and support each other with other internal control functions, i.e., legal counsel and business control.

Education, certification, knowledge, work experience
• Advanced degree in law or similar
• Appropriate knowledge and experience in Legal, Internal Audit, Accounting or similar
• Appropriate knowledge in applicable international and local laws (in particular distribution law, Anti-corruption, Anti-Money Laundering, Data Protection), Sanctions Lists and other applicable regulations and generally accepted CMS framework agreements.
• Professional qualification on responsible leadership, compliance or corporate sustainability is an advantage
• Knowledge in applicable international and local anti- corruption laws, regulations and generally accepted CMS framework agreements.
• Knowledge in applicable international and local Antitrust legislation
• Approx. 5 years business experience, sufficient stature within the organization to exert influence and credibility
• Demonstrated integrity within entity/business unit and detailed knowledge of Daimler Truck Code of Conduct and other relevant internal policies, guidelines
• Familiarity with corporate and local Daimler Truck business practices and sales processes
• Comprehensive knowledge and experience with change management and compliance, applied business ethics, culture change and communication
• Experience in compliance/legal (related) function, counseling of internationally operating enterprises
• Experience in (international) sales, business development or network development or similar complex models
